Lincoln is cracking down on so-called head shops

LINCOLN, Neb. -- The U.S. Attorney's Office for Nebraska's capital city handed down several federal indictments on storeowners Wednesday. Investigators confiscated more than 1,000 items they called drug paraphernalia from Super Exotica and Exotic Gift Emporium. "Pipes, coke kits, crack kits," said Lincoln police Chief Tom Casady.

U.S. attorney Mike Heavican said Wednesday's action is part of President George W. Bush's demand reduction efforts. Previously, the indicted owners would have faced misdemeanor charges and a $100 fine. Now the accused face three years in prison and forfeiture of profits.

"We think there is an element of deterrence we're doing today," Heavican said.

Omaha attorney James Martin Davis doesn't like the feds new strategy.

"This is the first time I've seen something like this," Davis said. "You've got people selling pipes and roach clips that could end up doing as much time as people doing manslaughter or robbery or assault."

Law enforcement and prosecutors make no apologies for their tough stance and said this is the right action.

"Let's be realistic about this," Casady said. "When have you ever seen anyone smoking tobacco in a hash pipe or a bong?"
